Government Schools and Unconstitutional Searches

As an attorney, I believe that government schools should be unconstitutional under the Fourth Amendment ban of unreasonable searches. The recent police-state raid in Goose Creek, South Carolina is another in the growing list of proofs (with more at http://rexcurry.net).

Government schools have a special exemption under the 4th Amendment, a lowered standard that promotes police-state raids. A raid was caught on videotape when gun-toting police burst into a high school, ordering students to lie flat on their stomachs in hall ways as they searched for drugs on Nov. 7, 2003. Police handcuffed anyone who apparently didn't comply quickly enough. The tape showed police waving their guns and searching lockers.

Worse still, the media reports that the school maintains constant video surveillance of students through various cameras available to police.

During my legal career, parents have asked me if it is wise (or constitutional) for government to control everyone's education.

Government schools create milquetoasts in the same way that Cuban schools create socialists. That is why parents leave their own children in government schools with constant video surveillance and police-state tactics. Government schools in the U.S. are different only in degree from schools in the former U.S.S.R.

The 4th amendment should be improved to specifically include "schools" with the same high standard given to homes. Of course, the only real solution is to end government schools. Many parents have already rescued their children from government schools in favor of the many better alternatives.

The U.S. did not have government schools when the Fourth (and First) Amendment was written. If the authors of the Constitution had foreseen the government's education monstrosity then the Fourth Amendment would have included government schools, and the First Amendment would have banned Congress from the establishment of religion and education.

The Constitution should be amended to include "education" next to "religion." The separation of school and state is as important as the separation of church and state. And for the same ideological reasons. The proposed constitutional amendment is discussed in detail at http://rexcurry.net .

Even if an excuse could be made for the initial creation of some government schools, their ongoing existence is proof of their ongoing failure to educate people to handle their own (or their childrens') educations without government schools.

The Post And Courier newspaper in Charleston reports that Goose Creek high school is one of the largest in the state with 2,760 students. It has an academic reputation as one of the Low country's best. But that doesn't show from the subservient comments of the students and parents.

The media reported that "the commando-style raid has parents questioning the wisdom of police tactics." It is sad that no media reported that the raid has parents questioning the wisdom of government schools. And that is more proof that government schools are dangerous and must end.

A media outlet reported that a parent said, "I was just upset knowing they had guns put to their head and a K9 was barking at them and about to bite somebody. It was awful." Only through years of government schooling can a parent say such a statement and not announce that she is withdrawing her student from government schools. She did not even question the constitutionality of government schools per se.

As if that weren't bad enough, the media reports that parents and students are already aware, and have done nothing about, the school's constant video surveillance available to police. The paper quoted a law enforcement officer as saying that he watched school surveillance tapes from four days that showed students congregating under various cameras, allegedly to avoid being filmed. "They know where the cameras are. If they stand directly under them, the camera's don't look directly down," the law enforcement officer told a paper.

The 4th amendment states "The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."

Police didn't find any criminals in the armed sweep nor any drugs. Goose Creek police and school administrators defended the draconian measures as necessary for crime prevention. For more information see http://rexcurry.net/.

Los Angeles Bans "Master & Slave" and "Mr. & Slav"?

Los Angeles officials have asked that suppliers of computer equipment stop using the terms "master" and "slave," saying such terms are offensive. The terms are sometimes used in reference to computer equipment. It is unclear whether the official policy applies to the words "Mr." and "Mrs." (Mister and Mistress) which are forms of "Master," or to the words "Slav" or "Slavic," the origin of the word "slave."

News outlets reported that a "discrimination complaint" alleged "offended sensitivities." The media did not report whether any Slav or the descendant of a Slav made the complaint. No one asked the Slavic community for comments at all. If it hasn't been done already, a complaint can be filed against the terms "Mr." and "Mrs." and "Slav" so that Los Angeles officials can expand their policy.

Reporters recounted that in 2000, the Los Angeles city council supported federal legislation seeking reparations for descendants of slaves. Not a single reporter revealed how much money any Slav descendant might receive, nor even whether the Slavic community supports the legislation.

The word "slave" has the etymological root "Slav" because Slavs were often enslaved. "Slavic" refers to a lot of people, including Caucasian, Slovak (Czechoslovakian), Slovene (Slovenia & parts of Austria & Italy), Polish, Serbo-Croatian, Bulgarian, Ukrainian, and Russian. Whites were enslaved around the world -especially the Slavs, from whom the
word is derived in both European languages and in Arabic.

According to the syndicated columnist Thomas Sowell, white slaves were still being bought and sold in Egypt years after the Emancipation Proclamation had freed many blacks in the United States. Not only does slavery predate the U.S., slavery is a practice that socialists and communists perpetuated well beyond the end of slavery in the U.S., perpetuating slavery even into the 1950's, arguably beyond. In addition to employing slavery, socialists and communists also employed genocide, and the Union of Soviet Socialist Republics, Communist China and the National Socialist German Workers' Party, slaughtered the most people, in that order.

Those Evil CONservatives and Their Patriot Act 2?

I find it absolutely amazing these days when I read about ‘Bush’s’ Patriot Act 2. The story goes something like this: “In an attempt to further abridge the freedoms we enjoy in this nation, Patriot Act 2 has been introduced into the Senate as S. 22 and our rights are being further eroded by it. Blah blah yadda yadda.” There is an as introduced version and a super secret leaked document that many are privy to so they can comment on it. Of course Bush and Ashcroft are being blamed for the whole thing.

I have a completely different take on it. First off, who created the entire discussion? Who else would do it, and why is it that it looks exactly like the same kind of attempted usurpations of the Constitution we saw for eight years? Here is the list of those who introduced the bill in the first place, taken directly from the bill as introduced:

“Mr. Daschle (for himself, Mr. Leahy, Mr. Biden, Mr Kennedy, Mr. Schumer, Mr. Durbin, Mrs. Clinton, Mrs. Murray, Mr. Dayton, Mr. Corzine and Mr. Reed) introduced the following bill; which was read twice and referred to the Committee on the Judiciary.”

Well that is an interesting array of freedom fighters isn’t it? I call them freedom fighters because they have been trying to trash freedom at any cost for years. We have Mrs. Klinton, who we know loves anything that can give her power, even a General at the moment. We have Kennedy, who tried to give our entire military budget to the IMF because they are so much more responsible than we are; never mind the fact that everything they touch miraculously implodes.

So what we have is the gun grabbers initiating the Patriot Act 2 through S. 22 on January 7, 2003 and suddenly it gets radically changed in secret and released to the public via ‘certain unnamed sources’? Like I said, what we find in that bill is exactly the same garbage we fought for eight years under “China's man in the White House" Bill Clinton. This is a classic fifth column tactic. These same people are now starting to speak out against this bill, and are claiming to be in favor of the document they have been using as a door mat for years (the Constitution). The liberals are still trying to reinvent themselves in our minds.

I do have to make a comment here about those who are claiming this was all created by Bush and company. You are either phony conservatives, not willing to do a little research, communists or synaptically challenged. Which is it? If you don’t know what I’m talking click on this link to my web page where I have been kind enough to cut and paste the appropriate section out of the congressional record of January 9, 2003, the same date on the entire super secret document currently being smeared on Bush by a bunch of people who claim to be conservatives. If you have taken the time to check out what I have placed here for you, I ask you to now go back and review everything you have gotten from those same ‘CONservative’ sources and start questioning both it and yourself. That is, if you can handle it.   

To me it is obvious that this Patriot Act is yet another liberal game. They have created a monster and are now trying to gut it and smear the entrails on Bush. Why would they do that? So you won’t bother to look up what I have looked up for you. The list at the top is the list of names that started the legislation in the first place and who put what into it isn’t anything but hearsay or, more probably, out and out lies. It is interesting that the dates on the super secret document actually match up with the date of Daschle introducing it don’t you think? I’m inclined to blame the same old collection of Miscreants and Mistercreants that introduced the bill for this new attempt at attacking our rights.

This Hegelian hoopla is typical made to order left wing poopla!

Ashcroft - The Scapegoat

The cry from the left against loss of freedoms is laughable in light of the fact that it was leftist policies that allowed 9-11 to happen in the first place. I am not tackling the larger issues of American meddling abroad in this column - just the administration of affairs here at home. John Ashcroft, while taking heat from Democrats (as well as from a lot of conservatives), should be commended by the left for doing all he can to maintain the level of slack border defense to which we have become accustomed, while keeping terrorism at bay. Yet Ashcroft has become the punching bag of Democrat candidates and voters alike.

No less than Democrat presidential hopeful Howard Dean said that Ashcroft "is not a patriot. John Ashcroft is a descendant of Joseph McCarthy..." (Washington Post.) No, Mr. Dean, Ashcroft - though labeled a conservative - is a descendant of the status quo which the anti-McCarthy people helped to create. He is doing all he can to ensure that we Americans remain safe in our homes and while travelling in a country which has had the gate welded in the "open" position.

Think about the reception any politician would get if the real solution to domestic terrorism were ever presented. Upon 9/11, these restrictions and actions should have occurred:

  1. Zero immigration.
  2. Zero international travel.
  3. Comprehensive Visa track-down (every foreigner from Islamic nations without a green card found and expelled - regardless of situation.)
  4. Every green card holder from Islamic nations tracked down, interviewed, and periodically re-contacted.

The above restrictions are not what was enacted. It would never be allowed.

Let's pretend America is a fashionable gated community. In such a place, a guard is placed at the entrance. Folks with legitimate business needs are let inside, and all others are turned away. All the people inside have a feeling of security because the gates are watched.

In America, the gate is left unattended. The security guard has to patrol the streets and periodically check inside the houses and buildings to make sure no one 'rough' has entered.

If the above list were enacted, soon afterward Americans should have been allowed to freely resume foreign travel, with strict interviewing and tracking placed on all foreigners from Islamic nations. No one from any Islamic nation should be allowed to "vacation" or "get an education" in America until international relations stabilise. This is the gatekeeper principle at work. The gatekeeper watches the borders, and the residents stay safe without having to have a prostate check every time they board a domestic flight. I think in the real world, the gatekeeper is called the U.S. Army - but I'm not sure if they still exist...they've been out of the country for some time now...

Ashcroft is a scapegoat - not your enemy. He is giving the majority of Americans the America for which they lobbied - successfully - for the last 50 years, and he's doing a fine job of it under the circumstances. Enjoy.
